Carsala.com, referred to in the following as the “Site”, is owned and operated by Carsala, Inc (“Carsala”). These Terms of Use apply to the national version of the Site as well as any version of the site that has been co-branded by one of our partners, referred to collectively as “Affiliates”. By using this Site, you hereby agree that you are at least eighteen (18) years of age and are bound by all of the following provisions of these Terms of Use and Carsala's associated Privacy Statement.
Carsala does not only operate online. Services that the business provides are physically carried out at Berkeley, California. While Carsala.com may be accessed from almost anywhere with internet access, we are bound by California law. Your respective state or country laws may differ from those of California; however, both Carsala and you agree that the laws of California govern all matters related to use of this Site. You and Carsala also agree and hereby submit to the exclusive personal jurisdiction and venue of the federal district and state courts of California with respect to such matters. Materials
Vehicle Images: the number of possible combinations of vehicle makes, models, styles, colors and options are potentially infinite. While the vehicle photos displayed on this Site will match your chosen vehicle as closely as possible, they are samples only and may not reflect your exact vehicle specifications. Carsala is not responsible for incorrect information given in the form of photos, including but not limited to that which is provided by vendors and other third parties.
Typographical Errors: While we try to make sure that all prices posted on the Site and communicated via phone and email are accurate, we cannot be responsible for the typographical and other errors that may appear on the Site. If there is incorrect information given about vehicle price, product, or service due to typographical error, Carsala is not responsible for such errors or their correction; but we will attempt to ensure that such errors are corrected as soon as they are detected. We reserve the right to refuse or cancel any orders for products or services listed at an incorrect price.
Site Outages and Browser Incompatibilities: Although special care is taken to ensure the reliability of our connection to our customers through Carsala servers, the Site may become inaccessible or it may not function properly with your web browser and operating system. Carsala cannot be held liable for any perceived or actual damages arising from Content, Materials, operation, or use of this Site.
Unsolicited Materials
Except for applications that allow public reception of Material on the Site such as Forums, chat rooms, and bulletin boards, unsolicited materials are strictly prohibited for use or publication in any form. Carsala shall not be responsible for any repercussions that occur due to the publication of unsolicited materials to the Site.
Interactive Forums
This Site may offer bulletin boards, message boards, chat rooms or other forums where public posting may be made. These applications will be collectively referred to as “Forums”. These applications are created to give users 18 years of age or older the opportunity to express their opinions and share their ideas. The ideas and opinions expressed in any of these Forums are not endorsed by Carsala or its Affiliates. Carsala advises its users to exercise their best judgment and to be considerate of others who use the Forum. You may not engage in any prohibited activities or criminal activities while using this Site; including the upload of any copyrighted or other proprietary Material of any kind on the Site, without the express permission of the owner of the aforementioned Materials or ideas being transmitted on the Site.
User Reviews, Comments and Communications: Our users may post reviews and comments, as well as ideas, suggestions and other types of information, so long as this information is not obscene, defamatory, or contains illegal content. You may not however, submit false email addresses, commercial solicitation or computer virus, and may not misappropriate another's identity. We are not responsible for any Content or communication posted on our website by any visitor.
Buying Used Cars
All assurances or promises referring to price quotes or any physical aspect of the vehicle is provided by the vehicle's respective seller—not Carsala. We do not endorse any seller, and we make no guarantee, explicit or implied that the information is accurate. You agree that we are not responsible for any information or content provided by any seller, including typographical and other errors. Although we attempt to verify all information we provide to you, we do not and cannot verify the information that sellers supply, nor do we guarantee the vehicle seller's offer or any offer made to you by Carsala. We assume no responsibility to verify whether the prices or quotes comply with applicable laws; such responsibility rests with the sellers. We are not responsible for, and do not guarantee the availability or performance of, any vehicles. Terms of any sale remain subject to direct negotiation between the buyer and the seller. Any dealings that you may have with a seller, whom you are referred to by Carsala are governed by the terms of the agreement that you enter into with that seller. Carsala expressly disclaims any liability or responsibility for the success of any transaction you have with that seller. You must make the final determination as to the value and appropriateness of the transaction.
With respect to prices, please note that the prices or quotes provided by Carsala may exclude sales tax, finance charges, and title, license, regulatory, dealer documentary, emission testing and compliance fees all of which may be added to the quoted price in determining the final sale price of a particular vehicle. Some of the vehicles are classified as “certified” vehicles. The decision to certify any particular vehicle is made by an individual dealer, and Carsala is not responsible for the decision to certify any vehicle.
Limitation of Liability
ANY ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM CARSALA OR THROUGH CARSALA.COM, SHALL NOT CREATE ANY WARRANTY UNLESS EXPRESSLY STATED IN THESE TERMS OF USE. IN NO EVENT SHALL CARSALA AND ITS AFFILIATES OR THEIR SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, COMPENSATORY, SPECIAL, INCIDENTAL, PUNATIVE OR CONSEQUENTIAL DAMAGES ARISING FROM THE OPERATION, CONTENT OR USE OF THE SITE; EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CARSALA RESERVES THE RIGHT TO DISCONTINUE SERVICE TO YOU OR REMOVE ANY MATERIALS YOU MAY HAVE MADE AVAILABLE ON THE SITE, FOR ANY REASON WHATSOEVER. CARSALA IS NOT RESPONSIBLE FOR PROVIDING ANY REFUND OR RELIEF, SHOULD YOU SUFFER PUNATIVE DAMAGES RESULTING FROM YOUR TERMINATION AS AN AUTHORIZED USER OF THE SITE. IT IS AT OUR SOLE DISCRETION WHETHER YOU HAVE VIOLATED ANY OF THE TERMS OF USE OR PRIVACY POLICY; AND TERMINATION OF YOUR ACCOUNT OR OTHER LEGAL ACTION MAY BE TAKEN AGAINST YOU.
